GENERALITY
These general conditions of sale apply to all purchases of products on www.fabbronivini.ch. The term "customer" used in the following text naturally refers to both men and women. The offers of products and services published online are valid as long as they are visible on the site and while stocks last. The illustrations on the site are provided for information only and are not binding. The information shown on the detail pages of each individual product and the explanations are to be considered as an indication and are not binding. Fabbroni Vini sagl declines all responsibility for any errors or inaccuracies relating to drawings, images or diagrams present in the aforementioned pages.

 

PRICES

The prices indicated on the site are exclusively expressed in Swiss francs. They are inclusive of VAT and do not include any packaging and shipping costs which will be billed separately. All orders are payable exclusively in Swiss francs. Fabbroni Vini sagl reserves the right to change its prices at any time. The prices invoiced to the customer for the products ordered remain those that were in force on the day the order was placed and appearing on the order confirmation. The promotional discounts offered on the site as part of specific commercial offers cannot be combined with other discounts, unless otherwise specified. These promotional discounts are directly deducted from the purchase order amount.

 

CONTRACT STIPULATION

The products and prices published in the online shop are valid as an offer. However, this offer is always subject to the (dissolution) conditions related to the impossibility of making a delivery or to an incorrect price indication (by the manufacturer or Fabbroni Vini sagl). The contract is to be considered stipulated as soon as the customer sends his order to Fabbroni Vini sagl. The receipt of the order is communicated to the customer through an order confirmation automatically generated and sent to the e-mail address indicated by him. Receipt of the automatically generated order confirmation does not imply any confirmation that the product is also really available or that it can be delivered. The order confirmation simply informs the customer that the order has been received by Fabbroni Vini sagl and that therefore the contract is in place, while remaining subject to the condition of the possibility of delivery. Orders can only be placed by individuals resident in Switzerland (individuals or companies) and the shipment takes place only in Switzerland.

 

PAYMENT

The invoiced price is the price indicated on the order confirmation that is sent to the customer. Unless special stipulations, all products and services are payable upon online order confirmation using the payment methods indicated in the Fabbroni Vini shop.

 

REPLACEMENT, RETURN, WARRANTY PERFORMANCE, CLAIMS AND NOTIFICATIONS OF DEFECT

Any complaints related to defective goods and / or incomplete services, as well as to returns must be exclusively presented by the customer directly to Fabbroni Vini sagl and treated there. The existence of such disputes does not release the customer from the obligation to pay the invoice or the full value of the subject of the dispute. It is the customer's responsibility to check the goods upon delivery. In principle, all items returned incomplete, damaged or soiled will not be taken back. The shipping costs in the event of a return of the goods are charged to the customer. Hidden defects must be reported in writing immediately after being detected. Unless otherwise notified, defective goods must be kept until they are returned and cannot be consumed.

 

QUALITY COMPLAINTS

Fabbroni Vini sagl keeps its own bottles of wine in compliance with the laws in force in Switzerland on the conservation of food and drinks. According to the indications of the Swiss Wine Trade Association, defective bottles will be replaced only in the case of wine from any origin but bottled in Switzerland, and in any case within one year of purchase. Foreign wines bottled abroad will neither be replaced nor refunded. The notification of any faults or defects must take place within 8 days of collection or receipt of the goods.

 

AGE LIMITS

By confirming the order with Fabbroni Vini sagl, the customer declares to be of age and to be of the necessary age to be able to purchase and consume alcohol in the country in which the order is placed. If Fabbroni Vini sagl should discover that the customer does not have the legal requirements to be able to purchase alcohol, Fabbroni Vini sagl will have every right to cancel the order immediately and without notice.

 

TERMINATION CLAUSE

The total or partial non-execution by the customer of one of his obligations and the non-compliance with a payment deadline will put Fabbroni Vini sagl in the condition of: being able to demand payment of the amount due, suspend all deliveries, withdraw from the current contract .

 

APPLICABLE LAW, DISPUTES

This contract is governed by Swiss law. Any disputes arising from or related to sales contracts will be the exclusive jurisdiction of the Lugano court
